California Small Claims Courts

California Small Claims Courts handles Civil cases asking for $10,000.00 or less. It is a special court where disputes are resolved quickly and inexpensively. Rules are simplified and the hearing is informal.

There are no lawyers, no rules of evidence, and no juries. Even though no lawyers are involved, before investing your time, energy and resources to this proceeding it is advisable to consult with an attorney to answer the following questions:

  • Do I have a chance to win the case?
  • What evidence I need to prepare in order to present a strong case?
  • Shall I settle or mediate?
  • How can I phrase the strongest statement to the Judge?
  • What is the appropriate court to file your claim in?
  • What are my options if I lose or win my case?

You don’t need to be a United States citizen to file or defend a case in Small Claims Court. 

Some examples of problems that can be handled in Small Claims Court are: 

  • Your car was damaged and the person responsible will not pay for repairs
  • Your friend will not pay back the money you loaned them
  • Your landlord will not return your security deposit
  • Your tenant damaged your property and the security deposit will not cover the full costs of repair
  • Your new TV does not work and the store will not repair it
  • You paid for services and person responsible will not perform them
